To simplify the administrative procedures for extending the patent term application, articles 4 and 10 of the “Regulations Governing the Determination of Patent Term Extension” was amended and released on June 28, 2023, and came into effect on July 1, 2023.
When an applicant applies for an extension of the patent term, if the materials during domestic and international clinical trials required for issuance of drug licenses as confirmed by Taiwan Food and Drug Administration (TFDA) to be submitted, TIPO can be directly used as the information for extending the patent term without sending it to TFDA for confirmation, which shortens the examination time effectively.
