Applicants or Right Holders May Apply For Restoration to Status Quo Ante for Patent or Trademark Applications if Failed to Comply With Statutory Periods Due to the Effects of the 2019-Novel Coronavirus Disease
 
In view of the recent epidemic situation of the 2019-Novel Coronavirus disease, if any applicants or right holders have failed to comply with any statutory periods due to effects of the disease, they may apply for restoration to the status quo ante by submitting to the Taiwan Intellectual Property Office (TIPO) a written statement clarifying said reason together with the evidences. TIPO in principle will be lenient when making decisions on such applications based on the actual situation in each individual case.

中国の新型コロナウイルスの流行拡大により、専利・商標の各項目出願案件の法定期間徒過に対する現状回復申請が可能
 
出願人または権利者が、新型コロナウイルスの感染拡大により各種出願の法定期間を徒過した場合、遅延理由を書面にて明記し、関連する証明書類を添付のうえ、台湾智慧財産局へ原状回復を申請することができます。台湾智慧財産局では原則的に個別案件ごとに具体的に状況に応じてこれを許可していく予定です。関連公告は下記URLにてご参照ください。

코로나19의 지속적인 확산으로 인하여 특허, 상표의 각종 신청안이 법정기간을 넘었을 경우, 회복신청을 할 수 있습니다.
 
최근 코로나19 상황으로 인하여 출원인 혹은 권리자가 법정기간을 넘길 경우 서면으로 원인과 증명문서를 첨부하여 대만지혜재산국에 회복신청을 할 수 있습니다. 그럴 경우 대만지혜재산국은 원칙상 각 케이스의 구체적인 상황에 따라 회복신청을 인정하고 있습니다.
